This privacy policy (“Privacy Policy”) sets out the basis on which we, The Dott Solutions Pte Ltd a company registered in Singapore, trading as preschooler.sg (“Preschooler.sg" or “we”) collects personal data from you and how we may collect, use, disclose or otherwise process the data. By visiting our website preschooler.sg (the "Site") or using Preschooler.sg program or any other applications or software we provide from time to time (collectively, the “Platform"), you accept and consent to the practices set out below.

COLLECTION OF INFORMATION

  • For the purposes outlined in Clause 2., we may collect, use, disclose or otherwise process the following information about you:
    1. Information you give us (which may include your name, address, email address, telephone number, credit card details and other personal identification data) by filling in forms on the Site and/or the Platform, or by corresponding with us (by phone, email or otherwise), for example: when you register for an account with us on the Site and/or the Platform:
      1. when you report any problem to us:
      2. when you use certain features on our Site and/or the Platform;
      3. when you request any support from us; or
      4. when you complete any survey or questionnaire we send you.
    2. Information automatically collected from you when you visit the Site and/or use the Platform, for example:
      1. technical information, including the Internet protocol (IP) address used to connect your computer to the Internet and your log-in information, browser type and version, time zone setting, browser plug-in types and versions, operating system and platform;
      2. details of any transactions, purchases and payments you made on the Site and in the Platform; and
      3. information about your visit, including the full Uniform Resource Locators (URLs), clickstream to, through and from our site (including date and time), products you viewed or searched for, page response times, download errors, length of visits to certain pages, page interaction information (such as scrolling, clicks, and mouse-overs), methods used to browse away from the page, and any phone number used to call our customer service number.
    3. Information we receive from third parties. We work with third parties and we may receive information about you from them, for example, business partners, sub-contractors in technical, payment and delivery services, advertising networks, analytics providers, search information providers, or credit reference agencies.
  • We only retain personal data for so long as it is necessary. Data may be archived as long as the purpose for which the data was used still exists.

USES MADE OF THE INFORMATION

  • We may use your information for the following purposes:
    1. providing, improving and developing our services;
    2. researching, designing and launching new features or products;
    3. presenting content and information in the Site and the Platform in the most effective manner for you and for the device you use;
    4. providing you with alerts, updates, materials or information about our services or other types of information that you requested or signed up to;
    5. complying with laws and regulations applicable to us in any part of the world;
    6. responding or taking part in legal proceedings, including seeking professional advice;
    7. for direct marketing purposes (please see further details in Clause 2.2 below);

  • We intend to use your personal data in direct marketing (i.e. offering or advertising products or services by sending the relevant information directly to you). We require your consent specifically for this purpose and you may opt out any time. For the purpose of this clause:
    1. the personal data that may be used in direct marketing are those that you provide to us or we collect from you under Clause 1.1 above;
    2. the type of services or products that may be offered or advertised:
    3. the relevant information may be sent to you via email, in-app message, messages or whatsapp;
    4. you may opt out any time by email us at [email protected]. We will cease to send you marketing information without charge.

DISCLOSURE OF YOUR INFORMATION

  • We will keep your personal data we hold confidential but you agree we may provide information to:
    1. any member of our group, which means our subsidiaries, our ultimate holding company and its subsidiaries, as defined under Section 5 of the Companies Act 1967;
    2. personnel, agents, advisers, auditors, contractors, financial institutions, and service providers in connection with our operations or services (for example staff engaged in the fulfilment of your order, the processing of your payment and the provision of support services);
    3. our overseas offices, affiliates, business partners and counterparts (on a need-to-know basis only);
    4. persons under a duty of confidentiality to us;
    5. persons to whom we are required to make disclosure under applicable laws and regulations in any part of the world; or
    6. actual or proposed transferees of our operations (or a substantial part thereof) in any part of the world.

  • Our Site uses cookies to distinguish you from other users of the Site and/or the Platform. This helps us to provide you with a personalised experience when you browse our Site or use the Platform and also allows us to improve the Site and/or the Platform.

  • All information you provide to us is stored on our secure servers.
  • Any payment transactions will be encrypted using TLS/SSL technology.
  • Where we have given you (or where you have chosen) a password that enables you to access certain parts of the Site and/or the Platform, you are responsible for keeping this password confidential. We ask you not to share a password with anyone.
  • We restrict access to personal information to our employees, service providers and contractors on a strictly need-to-know basis and ensure that those persons are subject to contractual confidentiality obligations.
  • We review our information collection, storage and processing practices from time to time to guard against unauthorised access, processing or use.
  • Please note, however, the transmission of information via the Internet is not completely secure. Although we will do our best to protect your personal data, we cannot guarantee the security of your data transmitted to the Site and/or the Platform; any transmission is at your own risk.

  • Any request under Clause 7.1 may be subject to a small administrative fee to meet our cost in processing your request.

By continuing to use the Site and/or the Platform after the changes come into effect means that you agree to be bound by the revised policy. Please read these terms of use carefully before using our website, platform or products.

These terms of use ("Terms") are a contract between you and Preschooler.sg (“Preschooler.sg” or "we") and govern your access to and use of the Preschooler.sg website (the "Site"), software and mobile application (such as for iPhone or Android) (collectively, the "Platform") and any classes, experiences, activities, events, services, recordings, and/or products made available through Preschooler.sg (collectively, the "Classes").

These Terms also include our privacy policy which can be accessed at http://localhost:8000/legal/#Policy.

1.
TERMS OF USE

  • Acceptance of these Terms : By accessing and/or using the Site, the Platform and/or the Classes, you accept and agree to be bound by these Terms, as if you had agreed to these Terms in writing. If you do not agree to these Terms, you must not use the Site, our Platform and/or the Classes. We recommend that you print a copy of these Terms for future reference.
  • Amendment of Terms : We may amend these Terms from time to time. Unless we provide a delayed effective date, all amendments will be effective upon posting of such updated Terms. You may determine if any such amendment has taken place by referring to the date on which the Terms were last updated. Your continued access to or use of the Site, the Platform and/or the Classes after such posting constitutes your consent to be bound by these Terms, as amended. Every time you wish to use the Site, our Platform and/or the Classes, please check the Terms to ensure you understand the Terms that apply at that time.
  • Additional Terms : In addition to these Terms, certain plans, offers, products, services, or features may be subject to additional terms, conditions, guidelines or rules which may be posted, communicated or modified by us or such applicable third parties at any time. Your use of any such plan, offer, product, service, or feature is subject to those additional terms and conditions, which are hereby incorporated by reference into these Terms, provided that in the event of any conflict between the additional terms and these Terms, these Terms shall prevail.

2.
PRESCHOOLER.SG PLATFORM

  • Preschooler.sg platform : The Site and/or the Platform enables Preschooler.sg account holders to purchase, book and attend trial classes of a wide range of activities offered by our service partners. Preschooler.sg does not operate or control any of the classes that are offered by our service partners through the Site and/or Platform.
  • Explorer Pass : To enjoy access to the Site, the Platform and/or the Classes, you will need to purchase a ticket known as the “Explorer Pass”. Depending on the ticket plan that you have chosen and purchased, you will be allotted passes to be used solely to book the Classes. You can choose how you use your passes across the various classes applicable to the ticket. Tickets expire at the end of the expiry date stated on the particular ticket. Upon expiry, any passes left over on the ticket will be forfeited. There will be no refund or payment for any unused passes.

    Passes have no cash value or any other value outside of the Platform and are not redeemable for cash. For the avoidance of doubt, the passes do not operate or serve as stored value facilities in any way. You may not transfer, trade, gift or otherwise exchange the passes (except for your child).
  • Class Availability and Allocation : The exact number and type of classes you can take depends on the ticket plan that you have chosen and purchased. Each pass is permitted to book only one class. We do not guarantee the availability of any particular service partner, class, experience, content, inventory, spot or other features, and availability may change over time and at any time.
  • Booking and Cancellation of Classes : After purchasing the Explorer Pass, you must book and cancel classes only through the Site and/or the Platform. If you reserve or cancel any classes directly with the service partners, we reserve the right to charge you the full amount that the service partner charges for such class and/or any applicable cancellation fees.

    If for any reason you are unable to attend any of the classes that you have booked, you must cancel the class with at least 3 working days’ prior notice. You are responsible for paying any applicable fees if you do not cancel a class you had reserved with at least 3 working days’ notice.
  • Preschooler.sg Account : Your Preschooler.sg account is personal to you and you agree not to create more than one account. You cannot transfer or gift classes to third parties (except if purchasing for your child) or allow any other persons to use your account. You must not use or exploit the Site, the Platform and/or the Classes for any commercial purpose. We continually update and test features on the Platform. We reserve the right to, and by using the Site, the Platform and/or Classes you agree that we may, include you in or exclude you from these tests without any prior notice. You understand and agree that we also may take any actions we deem reasonably necessary to prevent fraud and abuse of the Site, the Platform and/or the Classes.

    You agree that the information you provide to Preschooler.sg at the time of sign up will be true, accurate, current, and complete and that you will keep this information accurate and up-to-date at all times. When you sign up for an account, you will be asked to create a password for that account. You are solely responsible for all activity that occurs under your account, including any activity by unauthorized users.
  • Communications : By providing your information or creating an account, you agree that Preschooler.sg may contact you by email, post, telephone or text messages at any of the addresses or phone numbers, as applicable, provided by you for your account, including for marketing purposes. You may opt-out of marketing emails via the provided unsubscribe link or by contacting us at any time.

3.
PRESCHOOLER.SG PARTNER PORTAL

This clause 3 applies to the service partners of Preschooler.sg.

  • Partner Account : The Preschooler.sg partner account enables our service partners to list, and Preschooler.sg account holders to book, trial classes via the Platform and/or the Site. If you are a service partner, you agree that all information including your corporate information and activities you provide to Preschooler.sg at the time of sign up will be true, accurate, current, and complete and that you will keep this information accurate and up-to-date at all times. When you sign up for a partner account, you will be asked to create a password. You are solely responsible for all activity that occurs under your account, including any activity by unauthorized users.
  • Listing of information and Activity : If you are a service partner, you are responsible for keeping any content and information posted accurate and up to date. All service partners on the Platform and/or the Site must clearly state the terms of booking in their listings, including information such as company profile, marketing images, preparation request, and any fine-prints. Activity classes must always be available for booking at the pre-agreed allocated trial class slots until the service agreement with us is terminated.
  • Accepting Booking and Cancellation : If you are a service partner, you must fulfil bookings made by any Preschooler.sg account holders via the Platform and/or the Site on the pre-allocated trial class date, time and duration. Classes must go on even if they are not filled to the maximum capacity. There should also not be any minimum capacity for any classes. In the event that any classes cannot be held, you should make reasonable alternative arrangements and inform us and the Preschooler.sg account holders who have booked the classes via the Platform and/or the Site of the alternative arrangements at least 3 working days in advance.

4.
FEES, BILLING, CANCELLATION

  • Billing : By booking Preschooler.sg classes, you agree to comply with the applicable rules and policies of that particular class, and these rules may change from time to time. You are responsible for reading and understanding the full listing before committing to book any classes.
  • Refunds : Our fees are non-refundable unless we specifically communicate otherwise at the time of purchase. We do not provide refunds or make goods any expired or unused passes.
  • Price Changes : We reserve the right to adjust our pricing at any time. Unless we expressly communicate otherwise, any price changes will only affect new passes and any existing passes that have already been purchased will not be affected.
  • Other Fees : In addition to the fees we charge, our service partners may also charge a separate fee for equipment rental (such as the renting of roller blading equipment or rock climbing shoes) or other amenity fees, you will be responsible to pay these separate fees directly to our service partner. For the avoidance of doubt, Preschooler.sg only gives you access to the class which you booked on the Platform and/or the Site (and at the specified time and location) and the booking does not cover these additional fees that our service partners may charge.

5.
PROMOTIONS

  • Free Pass : From time to time we may offer a free pass that includes passes to book activities on the Platform and/or the Site. Unless we expressly communicate otherwise, such free passes are not transferable, may not be combined with other offers or redeemed for cash. We reserve the right, in our absolute discretion, to determine your eligibility for a Free Pass. If we decide in our absolute discretion that you are not eligible for a free pass or you have abused the use of a free pass, we reserve the right to terminate the free pass. If we terminate your free pass, you understand that you will not be eligible for any refund or replacement.
  • Refer a Friend : From time to time we may also make available certain incentives for users to refer a friend to use the Platform. If you decide to make use of our incentive schemes, you agree to abide by the terms and condition of such incentive schemes.

6.
TERMINATION OR MODIFICATION

  • You understand and agree that in the event of your failure to comply with these Terms, we may at any time and without prior notice: (1) terminate, cancel, deactivate, disable, delete and/or suspend your ticket, your account, any orders placed, or your access to or use of the Site, the Platform and/or Classes; and/or (2) discontinue, disable, suspend, modify or alter any aspect, feature or policy of the Site and/or the Platform including your use of the pass. This includes the right to terminate or modify any ticket prior to the end of any pre-paid or committed period. Upon any termination or otherwise, we may immediately deactivate your account and all related information and/or bar any further access to your account information and the Site. We shall have no liability for, and you shall have no recourse for, any such termination or deactivation. You agree that we shall not be liable to you or any third party for any termination or modification to the service regardless of the reason for such termination or modification. You acknowledge that your only right with respect to any dissatisfaction with any modification or discontinuation of service made by us is to cancel or terminate your usage to the site. If we delete your account for these reasons, you may not re-register for or use the Site and/or Classes under any other user name, email, payment method or profile. We may also block your access to the Site and/or the Platform to prevent re-registration.
  • All disclaimers, indemnities and exclusions in these Terms shall survive the aforesaid termination.

7.
USER SUBMISSIONS

  • General : The Site and/or the Platform may provide certain features which enable you and other users to submit, post, share and search for content and information, which may include (without limitation) text, graphic and pictorial works, profile information, information about any reserved or attended classes, friend connections or any other information submitted by you and other users or arising from your use of the Site and/or the Platform (“User Submissions”). User Submissions also include reviews, ratings and other feedback (“Reviews”). We strongly recommend that you think carefully about what you upload to, share with or make accessible to the Site. We do not guarantee any anonymity or confidentiality with respect to any User Submissions.
  • Reviews : You understand and agree that Reviews may be made public without any additional notice to or consent by you and you should assume that any person (whether or not a user of Preschooler.sg), including any service partners, may read or have access to your reviews. We are not responsible for the use or disclosure of any information that you disclose in connection with Reviews, including any personal information. Reviews are displayed for information purposes only and reflect the opinions of the person making the submission. They are not controlled by, and may not reflect the opinion of Preschooler.sg. You understand that all Reviews are the sole responsibility of the person from whom such Review originated. This means that you, and not Preschooler.sg, are entirely responsible for all Reviews that you upload, post, e-mail, transmit, or otherwise make available through the Site.
  • User Submissions : By accessing and/or using our services, you hereby grant us and our affiliates, sublicensees, partners, designees, and assignees of the Site and/or the Platform (collectively, the “Licensees”) a worldwide, non-exclusive, fully paid-up, royalty-free, perpetual, irrevocable, sub-licensable, and transferable license to use, reproduce (including by making mechanical reproductions), distribute, modify, adapt, translate, prepare derivative works of, publicly display, publish, publicly perform, and otherwise exploit your User Submissions and derivatives thereof in connection with the Site and/or the Platform and our (and our successors’) business for any purpose, including, without limitation, for marketing, promoting, and redistributing part or all of the Site and/or the Platform (and derivative works thereof), in any media formats and through any media channels now known or hereafter discovered or developed. You acknowledge that you may have what are known as “moral rights” in your User Submissions, for example the right to be named as the creator and the right not to have work subjected to derogatory treatment but you agree to waive any such moral rights you may have in User Submissions against us.
  • Inaccurate or Offensive User Submissions : You understand that when using the Site and/or the Platform, you may be exposed to User Submissions from a variety of sources and that we do not endorse and are not responsible for the accuracy, usefulness, safety, or intellectual property rights of or relating to such User Submissions. You further understand and acknowledge that you may be exposed to User Submissions that are inaccurate, offensive, indecent, or objectionable. You agree to waive, and hereby do waive, any legal or equitable rights or remedies you have or may have against us with respect thereto.
  • Feedback : If you provide us with any comments, bug reports, feedback, or modifications proposed or suggested by you to the Site ("Feedback"), we shall have the right to use such Feedback at our absolute discretion, including, but not limited to the incorporation of such suggested changes into the Site and/or the Platform. You hereby grant us a perpetual, irrevocable, nonexclusive license under all rights necessary to incorporate and use your Feedback for any purpose without notice to, consent by or compensation to you or any third party.
  • Infringing or Illegal Activity : In the event of infringing or other illegal activities, we have no obligation to, but reserve the right to terminate access to the Site and/or the Platform and remove all content submitted by any persons who are found to be infringers. Any suspected illegal activity may be referred to the appropriate law enforcement authorities. These remedies are in addition to any other remedies Preschooler.sg may have at law or in equity.

OWNERSHIP; PROPRIETARY RIGHTS; CONTENT

  • The preschooler.sg website and mobile applications are owned and operated by us. The content, recordings, visual interfaces, graphics, design, compilation, information, computer code, products, software (including any downloadable software), or any music, images, video, text, services, and all other material or elements of or available through the Site and/or the Platform provided by us ("Content") are protected by the relevant intellectual property laws of the Republic of Singapore and such other countries, or international conventions. Except for your User Submissions, all Content contained on the Site are the copyrighted property of us or our subsidiaries or affiliated companies and/or third-party licensors. All trademarks, service marks, and trade names are proprietary to us or our affiliates and/or third-party licensors whether registered or unregistered and may not be used in connection with any product or service or in any manner that is likely to cause confusion as to our endorsement, affiliation or sponsorship of any person, product or service. Except as expressly authorized by us, you agree not to sell, license, distribute, copy, modify, download, record, publicly perform or display, transmit, publish, edit, adapt, create derivative works from, or otherwise make unauthorized use of the Content and may only access the Content for your personal, non-commercial use. In the event that the Content are downloaded onto your computer or mobile phone, you do not obtain any ownership interest in such Content. All rights not expressly granted in these Terms are reserved.
  • By installing, copying, or otherwise using the Site or its software, you acknowledge that you have read and understood these Terms, and agree to be bound by its terms and conditions. If you do not agree to (or cannot comply with) the terms and conditions of this Agreement, do not install, copy, or use the Site, the Platform or Content.
  • You agree that you will not, for any reason whatsoever, reverse engineer, decompile, disassemble, or otherwise tamper with any security components, usage rules or other protection measures applicable to the Site, the Platform or Content. You agree to abide by the rules and policies established from time to time by Preschooler.sg. Such rules and policies will be applied generally in a non-discriminatory manner to users of the Site and the Platform, and may include, for example, required or automated updates, modifications, and/or reinstallations of the software and obtaining available patches to address security, interoperability, and/or performance issues.
  • You agree not to make any use of the Content that would infringe the copyright therein.
  • You agree not to share your Preschooler.sg account with anyone other than yourself nor will you allow anyone other than yourself to access or use any Content accessible on or through the Site and/or the Platform, including but not limited to sound recordings and/or musical compositions. You agree that you will not attempt to modify any software or Content obtained through the Site and/or the Platform for any reason whatsoever, including for the purpose of disguising or changing any indications of the ownership or source of the Content. You further understand that you are not granted any commercial, sale, resale, reproduction, distribution, or promotional use rights for the Content, or any rights for uses that require a synchronization or public performance license with respect to the underlying musical composition and any unauthorized reproduction or distribution of Content is expressly prohibited and may violate applicable law. You are not permitted to modify, edit or repurpose any Content.
  • Neither Preschooler.sg nor any owner of content will be liable for any incidental, punitive, special or consequential damages of any kind arising from the use of the site or from the software, content, information, materials or products included on or otherwise made available to you through the site, or for any damages in excess of the amount paid for the specific item of content giving rise to the applicable claim for damages.

THIRD-PARTY SITES, PRODUCTS AND SERVICES; LINKS

  • The Site and/or the Platform may include links or access to other web sites or services ("Linked Sites") solely as a convenience to users. We do not endorse any such Linked Sites, or the information, material, products, or services contained on other linked sites or accessible through other Linked Sites. Furthermore, we make no express or implied warranties with regard to the information, material, products, or services that are contained on or accessible through linked sites. Access and use of linked sites, including the information, material, content, products, and services on linked sites or available through linked sites, is solely at your own risk. In addition, when you click on a third-party link, you may leave the Site and/or the Platform. Any personal data you submit on the resulting site will not be collected or controlled by us but will be subject to the privacy policy or terms of use of the resulting site.
  • Sometimes promotional plans are offered in conjunction with the provision of third party products and services. We are not responsible for the products and services provided by such third parties, and use of such products and services is at your own risk.
  • Your correspondence or business dealings with, or participation in promotions of, third parties found on or through the Site and/or the Platform are solely between you and such third party. You agree that we will not be responsible or liable for any loss or damage of any sort incurred as the result of any such dealings or as the result of the presence of such third parties on the site.

GENERAL DISCLAIMERS; NO WARRANTIES

  • Classes and other products and services made available via the Site and/or the Platform are provided by our service partners who are third parties (and the descriptions of the foregoing posted on the site are provided by such third parties), not Preschooler.sg. To the fullest extent permissible by law, your use of the site and your attendance at, participation in, purchase and/or use of the classes, is solely at your own risk. We do not assume any liability or make any warranties of any kind, express or implied, arising out of, in connection with or with respect to the Site, the Platform and/or the Classes.
  • In no event shall we be liable for any act, error or omission by any third party, including without limitation, any which arises out of or is any way connected with a user’s attendance, use of or participation in a class or product, or the performance or non-performance of any third party. Preschooler.sg is not an agent of any third-party.

To the fullest extend permissible by law, we and our suppliers and service partners, disclaims and excludes all warranties, whether statutory, express or implied, including, but not limited to, implied warranties of merchantability, fitness for a particular purpose, and non-infringement of proprietary rights.

WAIVER AND RELEASE, INDEMNIFICATION, LIMITATION OF LIABILITY AND DAMAGES

  • You understand that there are certain inherent risks and dangers in attending classes and that the classes you may attend or participate in offer a range of activity and intensity levels. By using the Site, the Platform and/or the Classes, you acknowledge and agree, on behalf of yourself, your heirs, and/or personal representatives that you are aware of these risks which include, but are not limited to, property damage, illness, loss and bodily injury or death. You acknowledge that even though some of these risks cannot be excluded by law, you nevertheless specifically assume the risk of injury or harm on your own.
  • You also understand and agree that the Site and/or the Platform offers activity classes and related information that is designed for informational, educational and entertainment purposes only. Nothing stated or posted on or otherwise available through any aspect of the site and/or a class is intended to be, and must not be taken to be, the practice of medical, professional or counselling care. You should not rely on any non-professional medical advice, diagnosis, or treatment. The use of any of the content, recommendations and information provided on or through preschooler.sg is solely at your own risk.
  • To the fullest extent permitted by law, you agree to release, indemnify, and hold harmless Preschooler.sg, its parent, subsidiaries or affiliated entities, and each of their respective officers, directors, members, employees, consultants, contract employees, representatives and agents, and each of their respective successors and assigns, from any and all responsibility, claims, actions, suits, procedures, costs, expenses, damages and liabilities arising out of or in any way related to your participation in or use of the site and/or attendance at, participation in, purchase of and / or use of any class including but not limited to with respect to bodily injury, physical harm, loss, illness, death or property damage.
  • You agree to indemnify and hold Preschooler.sg, its affiliated entities, subsidiaries, its suppliers, service providers and partners and each of their respective officers, directors, members, employees, consultants, contract employees, representatives and agents, and each of their respective successors and assigns, harmless from any claims, actions, suits, costs, expenses, losses, damages, liabilities, including attorneys’ fees, arising out of or in connection with your misuse of the Site, the Platform, the Classes, violation of these Terms, violation of the rights of any other person or entity, or any breach of your representations, warranties, and covenants set forth in these Terms.
  • Under no circumstances will Preschooler.sg or its affiliates, contractors, employees, agents or third-party partners or suppliers be liable for any special, indirect, incidental, or consequential damages under any theory of liability, whether based in contract, tort (including negligence and product liability), or otherwise, even if Preschooler.sg has been advised of the possibility of such damages.

12.
GOVERNING LAW AND JURISDICTION

  • These Terms are governed by and shall be construed in accordance with the laws of the Republic of Singapore
  • The courts of the Republic of Singapore shall have exclusive jurisdiction to settle any dispute or claim arising out of or in connection with these Terms.

13.
GENERAL

  • A failure by us to exercise or enforce any rights conferred upon us by these Terms shall not be deemed to be a waiver or variation of any such rights or operate so as to bar the exercise or enforcement thereof at any subsequent time or times.
  • If any provision of these Terms is held to be unlawful, invalid or unenforceable, that provision shall be deemed severed and the validity and enforceability of the remaining provisions of these Terms shall not be affected.
  • A person who is not a party to these Terms shall have no right under the Contracts (Rights of Third Parties) Act 2001 to enforce any of these Terms, and the application of the Contracts (Rights of Third Parties) Act 2001 is expressly excluded.
  • You agree that we can transfer our rights and obligations under these Terms to any company, firm or person. You may not transfer your rights or obligations under these Terms to anyone else.
